A federal judge ruled Thursday that a Berkshire Hathaway unit must face a proposed antitrust class-action lawsuit.

The lawsuit alleges the company conspired to inflate commissions paid by home sellers to real estate agents.

HomeServices of America, a brokerage unit, previously settled the same claims for $250 million in 2024.

The judge rejected Berkshire Hathaway Energy's argument that it and its subsidiary constituted a single enterprise.

This ruling prevents the parent company from using the subsidiary's settlement to avoid additional damages.
