Delta Air Lines faces accusations of obstructing evidence in a trademark lawsuit filed by Alaska Airlines in the United Kingdom.
The dispute centers on Alaska’s claim that Delta infringed upon its exclusive U.S. rights to the Virgin America brand. Alaska alleges this infringement occurred when Delta-operated domestic flights were marketed and sold using the Virgin Atlantic loyalty program. Alaska Airlines is now seeking key documents from Delta, stating they are essential for the UK proceedings.
Although Delta is not a party to the UK lawsuit, it objects to the subpoena for documents. Delta argues the request is overly broad and has asked a court to quash the demand. This discovery request follows Alaska Airlines securing approval from a U.S. court in October 2025 to seek discovery from Delta for the UK proceedings.
