A federal court in the Northern District of California ruled that the trade dress for Deckers' popular UGG Classic Ultra Mini and Tasman styles are generic and therefore not protectable. This decision came in a lawsuit Deckers filed against e-commerce company Quince and could make it more difficult for the company to prevent competitors from selling footwear with a similar appearance. The court determined that Deckers did not meet its burden of proving that the designs were not generic. While this ruling is a setback for the brand's intellectual property protection on these specific styles, the court did leave one of Deckers' design patents for the Classic Ultra Mini intact. The immediate market reaction to this legal development was not available.
