New Fortress Energy (NFE) is engaged in a US$40 million arbitration with Jamaica Public Service Company (JPS). JPS initiated the proceedings to claim US$32.9 million in damages for fuel delivery disruptions. The utility incurred these costs by switching to alternative fuels when NFE's LNG supply failed. NFE filed a US$7.2 million counterclaim, citing force majeure as the legal defense. The dispute began in the first quarter of 2026 and expects resolution within the year. This issue predates NFE's May 2025 sale of its Jamaican operations to Excelerate Energy. The outcome could set a precedent for force majeure clauses in Jamaican energy contracts.
