The company argues plaintiffs cannot prove their claims after their lawyers withdrew two key expert witnesses. J&J contends no reliable scientific evidence remains to prove talc was a substantial contributing factor to cancer diagnoses.
This motion marks a new strategy in a legal battle involving tens of thousands of claims. J&J previously failed twice to resolve these liabilities through bankruptcy proceedings.
